The divorce rates for people over 50 has doubled since 1990. Many divorcing couples may go on to a second marriage. In fact, these days, more people have multiple marriages in their lifetime than ever before. If you are considering a second marriage, a prenuptial agreement offers certain protections for you and your loved ones.

A prenuptial agreement is a contract couples enters into prior to getting married, which details their rights in the event of divorce or death. A postnuptial agreement serves the same purpose, but is signed after a couple is married.

A prenuptial agreement or a postnuptial agreement for couples remarrying makes a lot of sense because mature couples often bring more assets to the marriage or have children from a previous marriage to consider.

A marital agreement allows couple to negotiate and agree upon the disposition of certain assets in advance of death or divorce. It may be a matter of specifying what assets children will receive or inherit, designating non-marital property as opposed to marital property, how a small business will be treated or even address alimony after a divorce.
