Collaborative Versus Uncontested Divorce

Lawmakers in Illinois have recently passed the Illinois Collaborative Process Act (750 ILCS 90/), a law that sanctions the team-based approach to amicable divorces.

In a collaborative divorce process, each spouse hires their own attorney for the sole purpose of settling their case. Professionals such as a neutral financial specialist, a mental health/child specialist or others may also weigh in on the process as needed to support the family.

Collaborative divorce is best suited to couples who are willing to work the issues out along with their respective attorneys and other professionals. If collaborative efforts fail, the couple’s attorneys withdraw from the case and the parties will have to secure new legal counsel.

Contrary to what many believe, a collaborative divorce is not inexpensive, but it is less costly than a litigated divorce. Sometimes when couples are willing and able to work together, they may opt for an uncontested divorce instead to reduce expenses further.

An uncontested Illinois divorce is very similar to a collaborative divorce. Both you and your spouse will agree on a reasonable settlement for your family. An attorney can provide legal guidance as needed and will file the necessary documents, without a need for a trial.

The key benefits of an uncontested divorce are the financial savings both in court costs and attorney fees. An uncontested divorce can expedite the divorce process so that the respective parties can move on with their lives. Much like a collaborative divorce, an uncontested divorce is less contentious because the two individuals work together to reach a settlement.

Uncontested divorce is best suited to couples that can address basic divorce concerns regarding parenting time, property division and spousal support if applicable. An attorney can provide information to help you sort out the details.
