Hefty Sum Awarded in Child Support Arrears Case

A Cook County Judge issued one of the largest child support rulings in Illinois history by ordering a local car dealership to pay 2.3 million for failure to withhold child support payments from an employee’s paycheck.

The case, originally filed for roughly $7K in past due child support, was brought by a woman whose husband failed to make his court ordered payments. When she and her legal representatives filed suit against his employer, they failed to comply and ended up having to pay not only the back support, but a hefty penalty to the tune of $100 daily plus interest for a grand total of of over 2 million dollars.

While certainly one of the largest amounts granted by a judge in such a case, it is not the first ruling of its kind. In 2007, the Illinois Supreme Court upheld a ruling in favor of a child support recipient for $1.2 million in penalties in a precedent-setting case, which underscores the state legislature’s efforts to strengthen child support laws by removing caps and damages.
