My Ex is Not Making Child Support Payments

If a parent fails to pay court ordered child support, there are a number of child support enforcement actions that may be taken to ensure the payment of child support.

Measures may be taken to garnish wages, place liens against property or real estate, freeze bank accounts, deny passport issuance, and suspend professional or drivers licenses. In some cases a debtor might land in jail, although this is usually reserved as a a last resort.

Sometimes a parent fails to pay child support simply because they lack the means to meet the obligation. However, if a parent is not able  to make payments, they are not released from the obligation until they file a formal motion requesting a modification of child support. This may allow the parent to decrease the amount of child support during periods of unemployment or under-employment and will give the other parent some idea of what to expect moving forward.
