Fair DUI Flyer at Sobriety Check Points

An attorney in Florida says he is tired of defending people who are wrongfully arrested after going through sobriety checkpoints. He believes he has developed a foolproof way to get through DUI stops, without saying a word to police. His advice is to display the needed information through a closed window by using his Fair DUI flyer and your drivers license. So far, he has developed flyers according to the laws of 12 states and he and a number of enthusiasts have developed a number of instructional You Tube videos.

The DUI flyer for one state reads “I remain silent. No searches. I want a lawyer.” followed by more specific information regarding the specific legal rights and responsibilities of the driver according to the laws in their state. When the flyer and license are displayed, many drivers are waved through a DUI checkpoint, without even rolling down windows, leading many to believe they have found a legal loophole to escape sobriety checks.

The creator of the flyers believes that drunk drivers should be taken off the roads, but feels that the current system also ends up hurting innocent people – the moment you roll down your window, the police may find reasons to cite you even if you are not driving drunk. It is a pretext to search for other things.

The Supreme Court ruled DUI checkpoints as legal in 1990. They are used in 38 states including Illinois to deter drunk driving, and studies show that they typically reduce alcohol related crashes by 9 percent. The president of Mothers Against Drunk Driving and many law enforcement agencies support the use of checkpoints. However, with the potential for abuses by law enforcement, the attorney and creator of the flyer is hoping someone will challenge their use, landing the issue in court so that the Supreme Court will have to take another look.
