Illinois Child Support Determinations

In order to determine child support for your child, you may be required to attend a hearing to answer relevant questions. The court may inquire about your marital status, the number of children involved, employment, income, living expenses and insurance coverage.

Using Illinois child support guidelines, the court will establish the percentage of the non-custodial parent’s net income that will go to the other parent, depending on the number of children the couple has together.

The net income is a person’s gross income minus certain deductions. The deductions may include state and federal taxes, health insurance premiums, payments for child support and spousal maintenance from a previous marriage, and reasonable medical expenses.

The court may deviate somewhat from the guidelines after considering the best interests of the child to include factors such as the financial resources and needs of the dependents and custodial parents, the physical and emotional condition of the children and their education needs, and the financial resources and needs of the non-custodial parent. Some attention may be given to the standard of living the children would have enjoyed had the marriage remained intact.
