Violation of an Illinois Parenting Time Order

It is not uncommon for child custody issues to arise despite having an established parenting plan following divorce. If your ex-spouse is violating an agreement, enforcement action can be initiated by filing a petition where the terms of the parenting plan and the nature of the violation are detailed.

If a court finds that the parent has indeed violated the parenting plan, they can impose certain remedies such as imposing additional terms to ensure compliance, granting make-up parenting time, ordering reimbursement of expenses incurred as a result of the violation and even requiring a parent to post a cash bond or other security to ensure future compliance.

There is also a possibility that the court will hold the violating party in contempt of court, which can result in further unpleasant sanctions such as probation, fines, or incarceration in some cases.

If you are dealing with a parent who is not abiding by a parenting time arrangement, the best course of action is to seek the help of an experienced attorney who will work with the court to ensure future compliance. Attorney Ronald L. Bell can help you if you have a parenting time, child support or other family law matter. Call today 847-495-6000.
